Security Deposit Demand Letter

A security deposit demand letter is a document written by a prior tenant demanding the refund of their security deposit funds from the landlord. If your landlord has not refunded your security deposit or accounted for its use, write a security deposit demand letter. Although you may have already sent a request asking for your refund, writing a demand letter is the appropriate next step in your effort to collect your refund. The purpose of this letter is to state your demand and to inform the landlord of the next step you will take.

Generally, the next step after a demand letter is a lawsuit in small claims court. In this article, you will learn about security deposit demand letters. We have provided a format you can use to write your demand statement and a sample letter demonstrating the format’s use.

Do Your Research

Each state has a security deposit refund law. This law states the length of time a landlord has to refund a tenant’s security deposit. Look up the requirement for your state and note the time limit. You will need to include this information in your letter.

What to Include in Your Security Deposit Demand Letter

Be sure to include the facts about your residence at the landlord’s property. Here are the items you should incorporate in your demand letter:

  • Subject line: Security Deposit Refund Demand
  • Beginning and end dates of residence
  • The apartment’s address
  • The date you paid the security deposit
  • The amount of the security deposit
  • The condition of the apartment before and after your residence
  • Demand for a refund of the security deposit
  • Your state’s legal time limit for refunds
  • The consequences of not refunding the deposit funds, such as a lawsuit

Important

If you always paid your rent on time and you did not break your lease, note this in your letter. If you and your landlord have a conflict about damages and their repair costs, you will need to write a formal dispute. Keep a copy of all your correspondence with your landlord. You may be required to prove you sent this demand letter if you need to sue your landlord for the security deposit funds. Send your demand letter via certified mail with return receipt requested and keep the receipt so you can prove the landlord received it.
