In many industries in the past, women returned to work after giving birth to a child much sooner than they do today. If they did not return to work, there might not a job for them and in many cases, they needed the money that the job provided. Fast forward to today and the laws have changed to provide more support for the mother and the father as well.

Under US law, § 825.100(a), new parents may take up to 12 weeks off if they meet the conditions of State and Federal law. Federal requirements state that the employee has worked a specified number of hours in the past 12 months and the organization has at least 50 employees. The parents are guaranteed their jobs back. There are specific rules and conditions covered under the Employer’s Guide to the FMLA provided by the Department of Labor.

What is a Maternity Leave Letter of Intent?

The maternity leave letter of intent is submitted to an employer by a parent to request time off to give birth, take care of the newborn baby and recover. The father or the mother can submit the letter and they are guaranteed their position back at the end of the specified term. In some jurisdictions, new parents are allowed to split their time off from the job for a total of 12 weeks.

There are terms and conditions specified in the law, which parents requesting maternity leave should be aware of. For example, the employee generally has the right to the same job, salary, and benefits when they return. If benefits are provided they continue when the parent returns and payment for benefits must continue while they are off work by the same parties that were paying the benefits – either the employer, the parent or both.

How to Write

The physician will provide advice concerning any potential medical issues, complications, and the date the baby is expected.

Once you have a date the baby is expected to be born, parents can decide how long they wish to work before the baby arrives. Some may decide they want time off before the birth date to make preparations, while others wish to work as long as possible to maximize their time with their newborn. Once this decision is made you can calculate the return date which should be specified in the letter.

The date you leave may also be discussed with your employer in advance depending on the job requirements. Providing advance notice helps the employer hire someone temporarily for the job and schedule training if needed.
